Community Rules (Swimming Pool) / Horizontal Law
#1
Hey, not sure if anyone else can advise.

We have been visiting a complex for 10 years before buying at the end of last year.  All the time we have been coming kids and adults have been allowed inflatables in the pool and have always played with balls in the pool (despite in the rules it does say no ball games - it was always over looked).

Since the new president was voted in a few years ago now anyone that doesn't live on the resort full time is being told no inflatables, no balls in the pool, no jumping in the pool and noise at a minimum.  This can happen 10-15 times a day if the pool gets busier.

The president does a great job in looking after the complex, but this side of things is ruining peoples experiences of the complex.  In this complex a lot of families holiday and it's starting to ruin peoples holidays.  They have been taking photos/filming kids with inflatables, asking people not to use inflatables and balls in the pool (I get balls as it's in the rules) and telling kids off for jumping in the pool (kids will be kids) - Although this often doesnt happen to residents.

These are the only rules in the community rules:

Art.6º: PISCINA.
 Horario de Piscina / Swimming pool opening hours
 10:00 a 20:00 horas (Verano - marzo a octubre) y 10:00 a 18:00 horas (Invierno - noviembre a febrero).
 10.00-20.00 (Summer – March - October) and 10.00-18.00 (Winter – NovemberFebruary).
 Swimming after this time is strictly forbidden.
 Sun beds should be removed from the swimming pool area and returned to the property at end of stay.
 Children under the age of 6 must be accompanied by an adult when using the pool.
 Los usuarios deberán ducharse antes del baño.
 Users must shower before entering the pool.
 Glasses, glass containers or bottles are not to be used in the swimming pool or the sunbathing area.
 Inflatables are not to be left around

Is there anything else that would cover the pool area?

The president is telling people it is Spanish law that no inflatables are allowed, is this true?

When I spoke to the community admins, they said that it is Horizontal Property Law that inflatables aren't allowed.

Can anyone advise on this?

I want kids to be able to come to the complex and have fun and not be told off every 2 minutes.

Other than this the president does a great job of helping everything run smoothly - I just don't like the gestapo approach - Especially when it wasn't like this for 7/8 years

TIA

It's in Caleta, the Amuley Mar 2 complex.

As I said, in general the complex runs really well - I just want the kids and families on holiday to enjoy themselves - so wanted to see if anyone understood the potential rules.

Ask the admin to produce the official Horizontal Law document stating the ban or the minutes of the community meeting where it was introduced. No answers then carry on would be my advice.

Of course, it might be a condition of the liability insurance...

Quite possibly.  Just looking to research further to get as much understanding as possible.  Easier to explain to guests that way Smile
