Do I have to register for Padron

The Living in Spain website, run by the UK government, is for folk who plan to live here as residents, rather than holidaymakers or what we used to call "Swallows" (they are now limited to 90 days in 180).   I think that could be a cause of the confusion. 

Residents: get on the padron as as we are now non-EU, renew every two years.
Non-residents: stay OFF the Padron.

It makes sense if you are moving to Spain to register for the Padron the dilemma is I still haven't seen evidence stating it's a requirement for a non-resident UK citizen to be on the Padron.

Q.  I own a holiday home here and wish to buy a vehicle. I am told I should register on the padrón?

A.   No holiday home owners should not register. The padrón  is only for habitual residents of Spain. Registering could have tax implications as the person inscribed is stating that they habitually reside in Spain.

We also registered on the Padron a few years ago. Before Brexit, not been back in since to check, must do so 🤔
We registered because a local expat was standing for council elections & was trying to increase votes & also because it increases the councils allocation of central funding for local services.
I now believe it can cause issues with Police if stopped while driving as they can apparently check on their system to see if you are on the Padron, this is taken as being “resident” even if not & can lead to a fine & tax implications.
There is a bit of an inconsistency here as I see it. On an island like this with a fair portion of non resident property owners, how can the councils get proper funding for services if we can’t register 🤷‍♂️
Incidentally, as far as I am aware, only an NIE is necessary to purchase a vehicle here, although dealers often say different, no idea why !

Had it confirmed by my solicitor that those with holiday homes who do not have a green card & are not residents do not have any legal need to be on the padron.

Thanks Beachlife, but the Green Card is almost a thing of the past now. Since Brexit it a TIE.

The Green 'card' is still perfectly valid, you only have to change to a TIE if you wish to. (New registrations automatically get a TIE.) I know a lot of residents who have decided to stay with the Green one.

We are non resident property owners (not renting our property out) and bought a new car in 2015.  At the time of purchase we were told we needed a padron which we obtained at the time.
Having read the above post it looks like we have to de-register.  Can anybody advise how to go about this? Thanks

You may find that you are already struck off the registry. 

I am in exactly like you, a property owner who was on the padron.

I heard that all British citizens were struck off after Brexit. So I went in to register & when I did, I was told I was not on their system, which seemed to clarify what I had heard about Brits being struck off. It was at this point I decided to find out if it was a requirement.

As far as I can see, you have 2 ways forward

1. Go in & ask if you are registered on the padron.

2. Once you know the answer to the first option, then you can decide to ask to deregister if you wish or register.

Each of us have to make a decision according to the evidence we believe is correct.

Personally, I have decided not to register due to the weight of evidence you can gleam from the posts here & in the links provided. 

Good luck. As usual with the Spanish authorities, we are all left on our own to work out the correct thing to do.

I renewed mine online (La Oliva) last night and received it be email this morning. It cost €2.50
