The Second Section of the Provincial Court of Las Palmas will host on July 1 the trial against two Italian citizens, identified as D.A.L. and F.T., accused by the Prosecutor's Office of using a cannabis association as a front for marijuana trafficking in the south of Fuerteventura. The Prosecutor's Office is requesting five years in prison for each of them and the definitive dissolution of the entity.
According to the indictment, the defendants founded the "Fuerteventura Hemp Association" on May 12, 2018, based in a premises of the Cosmos Shopping Center, in Morro Jable, with the aim of giving a legal appearance to an activity that they describe as "illicit sale of drugs to third parties". F.T. acted as president and D.A.L. as treasurer.
During the investigations, the agents identified a marijuana crop in the Barranco La Torre (Antigua), allegedly managed by the defendants through another person.
In searches carried out on March 28, 2019, 2,541.69 grams of marijuana, precision scales, price lists and 1,404.30 euros in cash were seized, which according to the Prosecutor's Office came from the illegal sale of drugs.
The accusation includes a crime of drug trafficking, in the form of substances that do not cause serious damage to health, and a crime of illicit association.
For each of the crimes, the Prosecutor's Office requests sentences of two and three years in prison respectively, fines of up to 13,500 euros, and special disqualification from employment or public office for ten years.
The accusation is specified in alleged crimes of drug trafficking, in the modality of substances that do not cause serious damage to health, and illicit association
Likewise, the Public Prosecutor's Office demands the definitive confiscation of the drug, the seized effects and the Money seized.
In its brief, it points out that the expulsion of the defendants from the national territory is not appropriate, as they are EU citizens with no criminal record and do not represent a serious threat to public order.
The Prosecutor's Office also asks for the dissolution of the cannabis association "Fuerteventura Hemp" and the prohibition of "carrying out any activity, even if it is legal".
