Willy, I could be mistaken, so this needs checking out, but I understood that the spouse of an EU national doesn't need residency. That limits the ability of the person to travel only with the EU national, but I think that is the only limitation.
Check with Age in Spain and Citizens Advice Bureau Spain, or seek a second opinion from another solicitor.
Please post what advice you are given, so we all know the outcome.

No, spouse of an EU National must get residency (I'm EU and my wife is here as an EU spouse). Same for anyone, after 90 days. If travelling wiht me then passport would not get stamped, if travelling alone then should have card (and allegedly marriage certificate) but passport may be stamped.
In practice she shows passport and residency card and has never been asked for marriage certificate or had passport stamped. That's 3 years over here now and multiple trips back to the UK.
Also both of us get the resident's discount on inter-Spain and Island travel.
We used Rosy from Elwell who has been excellent. I do NOT recommend certain ex-pat organisations who claim to do the same thing.

Thanks for your reply guys and sounds very interesting. How long did your wife's residency take to come through, form initial application to getting the residency paperwork.
