The Prosecutor's Office is requesting four years and six months in prison, in addition to a fine of 15,000 euros
The First Section of the Provincial Court of Las Palmas is holding this Tuesday, June 10, the trial against a man accused of a crime against public health for possession of drugs intended for illicit trafficking on the island of Fuerteventura.
According to the indictment of the Public Prosecutor's Office, the Events occurred on the afternoon of January 1, 2021 on El Poril Street in Corralejo, in the municipality of La Oliva.
Law enforcement agents seized a backpack containing 2,139.03 grams of cannabis resin (hashish) and 20.97 grams of cocaine with an average richness of 56.28 percent, in addition to a digital scale allegedly used to weigh the drug before sale.
The Prosecutor's Office maintains that the backpack belonged to the defendant, identified as D.E.R.T., who would have given it to a third party without informing him of the real contents, with the aim of using it for drug trafficking. The total value of the seized drug is estimated at 5,818.86 euros.
The Public Prosecutor's Office classifies the facts as constituting a crime of drug trafficking in the form of substances that cause serious damage to health, typified in article 368 of the Criminal Code, and requests a sentence of four years and six months in prison, as well as a fine of 15,000 euros, with five months of subsidiary imprisonment in case of non-payment, in addition to the special disqualification for the exercise of the right to passive suffrage during the sentence.
The defendant has a criminal record for previous crimes, although not computable for the purposes of recidivism. In principle, there may be an agreement between the accused and the Prosecutor's Office in the same act of the trial.
